These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and FissionCore Ltd (“FissionCore,” “we,” “us,” or “our”), governing your access to and use of fissioncore.com(the “Site”).

By accessing or using the Site you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About the Site

FissionCore is a web design and development agency based in Victoria, BC, Canada. The Site is an informational and marketing resource describing our services, portfolio, and expertise. It includes a contact form through which prospective clients may reach us.

2. Eligibility

You must be at least 18 years old to use the Site. By using the Site you represent that you meet this requirement and have the legal capacity to enter into a binding agreement.

3. Acceptable Use

You agree to use the Site only for lawful purposes. You must not:

  • Submit false, misleading, or fraudulent information through the contact form.
  • Use automated scripts, bots, or scrapers to access or harvest content from the Site without our written permission.
  • Attempt to gain unauthorised access to any part of the Site or its underlying infrastructure.
  • Introduce malware, viruses, or any other harmful code to the Site.
  • Abuse the contact form (e.g. sending spam or repeated unsolicited messages).
  • Violate any applicable local, provincial, federal, or international law or regulation.

We reserve the right to block access to any user who violates these Terms.

4. Intellectual Property

All content on the Site — including text, images, graphics, logos, icons, and code — is owned by or licensed to FissionCore Ltd and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may view and print pages from the Site for personal, non-commercial reference only. Any other reproduction, distribution, modification, or commercial use requires our prior written consent.

“FissionCore” and associated logos are trademarks of FissionCore Ltd. You may not use these marks without our prior written permission.

5. Contact Form

Submitting the contact form does not create a client relationship or any contractual obligation on the part of FissionCore. A binding engagement only arises if and when both parties execute a written agreement or statement of work.

We may decline to respond to enquiries at our sole discretion.

6. Third-Party Content and Links

The Site may contain links to third-party websites and embedded content (e.g. YouTube videos). These are provided for convenience only. We have no control over, and accept no responsibility for, the content, privacy practices, or availability of any third-party site or service.

7. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Information on the Site may not always be current, complete, or accurate.

8. Limitation of Liability

To the maximum extent permitted by applicable law, FissionCore Ltd, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business opportunities — arising from your use of or inability to use the Site, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to the Site shall not exceed CAD $100.

Some jurisdictions do not permit the exclusion or limitation of certain damages; the above limitations apply to the fullest extent permitted by law in your jurisdiction.

9. Indemnification

You agree to indemnify, defend, and hold harmless FissionCore Ltd and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Site or your violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the courts of British Columbia, Canada, and you consent to personal jurisdiction in those courts.

If you are an EU consumer, you may also benefit from mandatory consumer-protection provisions in your country of residence.

11. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page and updating the “Last updated” date. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Site.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
